Bypass system sound setting objective c

Hi. I have an app that Is supposed to play a AudioServicesPlayAlertSound(); but I've noticed on the iPod touch 1G, the sound will only play if the system sound setting is set to speaker or both. Is there a way to bypass this setting, because I know it works when the setting is not set to headphones. Also, if it is not possible, is there a way to alert the user to change this setting? I have a iPod touch 1G to test with, just incase.
