Now and then someone makes a weird argument for software patents. What are the best reasons against software patents? What are the best replies for commonly heard arguments of patent proponents?

See also the converse question of the dark side. :-) If you are for patents you might want to answer there to keep the stackoverflow philosophy of answers instead of discussions.
