  • If we write iOS and sell on App Store, are we protected for legal consequences? [closed]

    Will the developer or company (is a corporation or is not) be responsible for legal consequences, or will they be covered and protected by the Apple Store Terms of Use agreement? For example: 1) the app is fun and the kids show the app to a parent who is driving the car, and got into an accident. 2) if the app does road navigation and it went into problem or crash or slow, and caused an accident while driving. 3) or if the terms require using an app in a safe and non-time critical situation, what if the app recommend some exercise routine or diet (such as suggesting eating more eggs, milk, or using some herbs), and it could be argued that they caused any health consequence?

  • License similar to the MIT license but without the ability to sell?

    I'm trying to decide how I want to license my Wordpress themes to the public. I know that the GPL is recommended to Wordpress theme creators, however I feel it might not be liberal enough for me because I want businesses to be able to use them if they want to. I really like the MIT license, the only thing that gets me is the freedom to sell part. I don't want someone taking my themes and selling them on some theme farm site, they should be free for everyone, however I don't want to require them to republish any changes under the MIT as well, I think that that freedom should remain intact. Is there a license that sort of fits into the terms I specified here? I'm not a lawyer so I have trouble reading through the complicated language of licenses. If there is not a similar license to the MIT but with the terms I have specified, should I just license under a modified MIT? If so, can anyone help me write it? Thanks very much!

  • Anyone know of a good way to sell used servers?

    We have a couple of servers we no longer need now that we are fully hosted on a managed host (rackspace). They were purchased for over $10,000 each but we realize that over time their monetary value drops. Anyone have suggestions or experience selling these in a proper way? They are dual xeon processor 2U rack mountable with 4+GB RAM, intel boards, 6x 72GB 15,000 RPM SCSI Drives with raid controller redundant power supply. We are in Southern California area. I can be more specific on any information if there is interest. I know there is ebay and the like but these servers are like the family dog that has to be given up and we are looking for a proper home for a fair price. I will end up auctioning it off if need be in the end though. Thanks in advanced for any help!

  • Sending large files - do any vendors sell their solution?

    We currently have an account with www.mailbigfile.com to allow us to send & receive files which exceed our client's email limits. In our industry, a 10MB limit is not unknown. Mailbigfile works fine for what it is but increasingly, our clients are starting to block it as a security risk. A solution would be for us to license the software and run it from our own web server which is far less likely to be blocked. Does anyone know of vendors in this market? We are looking at web collaboration systems but that's a much bigger project. The technology behind www.mailbigfile.com isn't that complex (http upload, email notification and then http download) so I'm hoping it won't be very expensive. Cheers, Rob.

  • Throughput and why do ISPs sell too much bandwidth?

    I hope the question made sense how I worded it. :) I've been wondering, maximum theoretical bandwidth is measured as RWIN/RTT (Window size / round trip time) Source 1 and Souce 2 So if a major city only 100 miles away gives me a ping of 50ms, and I have the default 64kb TCP window size then my maximum throughput will be 12.5Mb/s. Everything further away would give me a higher ping and therefore a lower throughput. Is there any reason to buy something like FiOS with a 50Mb/s or greater connection? Will you ever be able to reach that kind of speed? I know you can increase the TCP window size to increase throughput, but it has to be at both ends which is a deal breaker because you can't control the server. I'm assuming other network protocols like UDP aren't quite as affected by latency as TCP is, but how much of overall network traffic does non-TCP make up vs TCP. Am I just misguided about how throughput works? But if the above is correct, then why should a consumer like me buy way more bandwidth than can be realistically used. Maybe the only reason is for downloading multiple things at once, or one thing from multiple servers/peers?

    The New Strategic Selling Miller and Heiman Amazon.ca Amazon.com Chapters Everybody is a salesmen. Every day, without knowing it, we sell something to someone. Now, the typical vision people think of when they hear the word “sales” is the sleazy used car salesperson who does whatever they can to get you to buy the clunker on their lot. But selling is not an action tied to money and products. Selling is about convincing people to see your point of view and act on it. If you want your company to cover a trip to a conference, you may have to sell the idea to your boss. If you want to buy that new big screen TV, you have to sell the idea to your significant other. If you want to go on a weekend fishing trip with the boys you might be called in to help sell the idea to your buddies wife. We all sell, but we don’t all sell very well. So enter The New Strategic Selling, a book based on the sales course put on by the Miller-Heiman group. In fact, this isn’t really a “New” strategy to selling as its been around for a number of years. But the concepts they present, the ideas about selling, these are still very radical based on what most of us have experienced. Gone are the high pressure, win at all cost, GlenGarry-GlenRoss style of sales…instead the book presents a framework to switch to need-based selling. It’s the idea that instead of going in raving about a product or service, you build a relationship where the buyer expresses what their needs are and your response is to present a solution that best fits that need. Instead of focussing on the amount of money you can squeeze out of a client, you focus on whether everyone wins, that they receive win-results from the engagement, that repeat business is developed over time delivering value over and over again. The great thing about the book is that what it teaches…things like how to identify different buying influencers, how to prepare for meetings, techniques to solicit information about what the buyer is really thinking/feeling…these things are entirely applicable in *any* situation that you need to sell to someone…and remember: selling is convincing people to see your point of view and act on it. So that new big screen TV you want to buy but need to convince your wife on? This book can help you. That training opportunity you want your company to send you on? This book can help you. The upgrade to your community park that you want to lobby the local civic authorities for? This book can help you. The book is a bit wordy. I found that the length could have been reduced and the points still have gotten across. That’s really the only knock that I have though; the insight that it provides is so worthwhile that having to chew through extra words is well worth it. You definitely don’t have to be a professional salesperson to benefit from this book. Rating: 4/5

  • Visual Studio Little Wonders: Box Selection

    So this week I decided I’d do a Little Wonder of a different kind and focus on an underused IDE improvement: Visual Studio’s Box Selection capability. This is a handy feature that many people still don’t realize was made available in Visual Studio 2010 (and beyond).  True, there have been other editors in the past with this capability, but now that it’s fully part of Visual Studio we can enjoy it’s goodness from within our own IDE. So, for those of you who don’t know what box selection is and what it allows you to do, read on! Sometimes, we want to select beyond the horizontal… The problem with traditional text selection in many editors is that it is horizontally oriented.  Sure, you can select multiple rows, but if you do you will pull in the entire row (at least for the middle rows).  Under the old selection scheme, if you wanted to select a portion of text from each row (a “box” of text) you were out of luck.  Box selection rectifies this by allowing you to select a box of text that bounded by a selection rectangle that you can grow horizontally or vertically.  So let’s think a situation that could occur where this comes in handy. Let’s say, for instance, that we are defining an enum in our code that we want to be able to translate into some string values (possibly to be stored in a database, output to screen, etc.). Perhaps such an enum would look like this: 1: public enum OrderType 2: { 3: Buy, // buy shares of a commodity 4: Sell, // sell shares of a commodity 5: Exchange, // exchange one commodity for another 6: Cancel, // cancel an order for a commodity 7: } 8:  Now, let’s say we are in the process of creating a Dictionary<K,V> to translate our OrderType: 1: var translator = new Dictionary<OrderType, string> 2: { 3: // do I really want to retype all this??? 4: }; Yes the example above is contrived so that we will pull some garbage if we do a multi-line select. I could select the lines above using the traditional multi-line selection: And then paste them into the translator code, which would result in this: 1: var translator = new Dictionary<OrderType, string> 2: { 3: Buy, // buy shares of a commodity 4: Sell, // sell shares of a commodity 5: Exchange, // exchange one commodity for another 6: Cancel, // cancel an order for a commodity 7: }; But I have a lot of junk there, sure I can manually clear it out, or use some search and replace magic, but if this were hundreds of lines instead of just a few that would quickly become cumbersome. The Box Selection Now that we have the ability to create box selections, we can select the box of text to delete!  Most of us are familiar with the fact we can drag the mouse (or hold [Shift] and use the arrow keys) to create a selection that can span multiple rows: Box selection, however, actually allows us to select a box instead of the typical horizontal lines: Then we can press the [delete] key and the pesky comments are all gone! You can do this either by holding down [Alt] while you select with your mouse, or by holding down [Alt+Shift] and using the arrow keys on the keyboard to grow the box horizontally or vertically. So now we have: 1: var translator = new Dictionary<OrderType, string> 2: { 3: Buy, 4: Sell, 5: Exchange, 6: Cancel, 7: }; Which is closer, but we still need an opening curly, the string to translate to, and the closing curly and comma. Fortunately, again, this is easy with box selections due to the fact box selection can even work for a zero-width selection! That is, hold down [Alt] and either drag down with no width, or hold down [Alt+Shift] and arrow down and you will define a selection range with no width, essentially, a vertical line selection: Notice the faint selection line on the right? So why is this useful? Well, just like with any selected range, we can type and it will replace the selection. What does this mean for box selections? It means that we can insert the same text all the way down on each line! If we have the same selection above, and type a curly and a space, we’d get: Imagine doing this over hundreds of lines and think of what a time saver it could be! Now make a zero-width selection on the other side: And type a curly and a comma, and we’d get: So close! Now finally, imagine we’ve already defined these strings somewhere and want to paste them in: 1: const private string BuyText = "Buy Shares"; 2: const private string SellText = "Sell Shares"; 3: const private string ExchangeText = "Exchange"; 4: const private string CancelText = "Cancel"; We can, again, use our box selection to pull out the constant names: And clicking copy (or [CTRL+C]) and then selecting a range to paste into: And finally clicking paste (or [CTRL+V]) to get the final result: 1: var translator = new Dictionary<OrderType, string> 2: { 3: { Buy, BuyText }, 4: { Sell, SellText }, 5: { Exchange, ExchangeText }, 6: { Cancel, CancelText }, 7: };   Sure, this was a contrived example, but I’m sure you’ll agree that it adds myriad possibilities of new ways to copy and paste vertical selections, as well as inserting text across a vertical slice. Summary: While box selection has been around in other editors, we finally get to experience it in VS2010 and beyond. It is extremely handy for selecting columns of information for cutting, copying, and pasting. In addition, it allows you to create a zero-width vertical insertion point that can be used to enter the same text across multiple rows. Imagine the time you can save adding repetitive code across multiple lines!  Try it, the more you use it, the more you’ll love it! Sample bogus and hyper simplified database: Table prod: prodID 1 prodName Flux capacitor prodCost 900 prodPrice 1350 (900*1.5) prodStock 3 - prodID 2 prodName Mr Fusion prodCost 300 prodPrice 600 (300*2) prodStock 2 - prodID 3 prodName Time travel kit prodCost 1650 (1350+300) prodPrice 2145 (1650*1.3) prodStock 2 Table rels relID 1 relSrc 1 (Flux capacitor) relType 4 (is a subpart of) relDst 3 (Time travel kit) - relID 2 relSrc 2 (Mr Fusion) relType 4 (is a subpart of) relDst 3 (Time travel kit) prodPrice: it's calculated based on the cost but not in a linear way. In this example for costs of 500 or less, the markup is a 200%. For costs of 500-1000 the markup is 150%. I can sell kits or the individual parts, So the stock of the kits is virtual. The problem when I buy: Some providers sell me the Time Travel kit as a whole (with one barcode) and some sells me the individual parts (with a different barcode) So when I load the stock I don't know how to impute it. The problem when I sell: If I only sell kits, calculate the stock would be easy: "I have 3 Flux capacitors and 2 Mr Fusions, so I have 2 Time travel kits and a Flux Capacitor" But I can sell Kits or individual parts. I have to track the stock of the individual parts and the possible kits at the same time (and I have to compensate for the sell price) Probably this is really simple, but I can't see a simple solution. Resuming: I have to find a way of tracking the stock and the database/program is the one who has to do it (I cant ask the clerk to correct the stock) I'm using php+MySql. But this is more a logical problem than a programing one

    What is the way to implement "business rules" in Rails? Let us say I have a car and want to sell it: car = Cars.find(24) car.sell car.sell method will check a few things: does current_user own the car? check: car.user_id == current_user.id is the car listed for sale in the sales catalog? check: car.catalogs.ids.include? car.id if all o.k. then car is marked as sold. I was thinking of creating a class called Rules: class Rules def initialize(user,car) @user = user @car = car end def can_sell_car? @car.user_id == @user.id && @car.catalogs.ids.include? @car.id end end And using it like this: def Car def sell if Rules.new(current_user,self).can_sell_car ..sell the car... else @error_message = "Cannot sell this car" nil end end end As for getting the current_user, I was thinking of storing it in a global variable? I think that whenever a controller action is called, it's always a "fresh" call right? If so then storing the current user as a global variable should not introduce any risks..(like some other user being able to access another user's details) Any insights are appreciated! UPDATE So, the global variable route is out! Thanks to PeterWong for pointing out that global variables persist! I've now thinking of using this way: class Rules def self.can_sell_car?(current_user, car) ......checks.... end end And then calling Rules.can_sell_car?(current_user,@car) from the controller action. Any thoughts on this new way?

  • What are the best strategies for selling Android apps?

    I'm a young developer hoping to sell my apps I made for Android soon. My applications are basically 99% finished so I'm investigating what would be the best marketing strategy to use to sell my apps. I'm sure the brilliant minds here can give me some great advice. I'm particularly interested in your thoughts on the following points (especially from experienced Android developers): Is it more profitable to sell an app for free with ads or to sell an app without ads for a price? Perhaps a combination of a free ad version and a paid ad-free version? If you give away an app for free with ads on it is it ethical to decline bending over backwards to support it? How much does piracy actually affect potential sales? Should any effort be put towards preventing it? Can you still make a profit off your application if you make it open source? Could you perhaps make more of a profit from the attention you would get by doing so? Is Google's Android Marketplace really the best place to release Android apps? It is worthwhile enough to maintain a developer blog or website to keep users updated on your development progress and software releases? Any other suggestions you could give me to maximize profit meanwhile keeping users happy and coming back for more would also be greatly appreciated. While I appreciate general tips and tricks, I'd like to ask that if possible you please go the extra step and show how they specifically apply to selling Android apps. Marketing statistics, developer retrospect, and any additional experience you can share from your time selling Android apps is what I would love to see most.     Ok, I know if I am Red hat or other giant and offer some support etc. I can be profitable, in fact, Red Hat is doing quite well. However, what about a small company where I create a small program. e.g. an instant messenger for a windows or linux (just as an illustration) and I want to sell it. But how can I sell it if it is free and everybody can download it? Any advice? I like the idea of FSF by Richard Stallman, however I am missing the way how to sell my software under GNU/GPL licence. Any advice, how can I solve this problem? Any profitable small business software developers around with their opinion? Any links or names of small companies taht I can look at and study their model of business?

    Hey everybody - I have an open source project that I'm working on and I'm trying to figure out what liscense would be the best match. Essentially my project is a framework that developers will use to create projects of their own. The vision I had for the licensing of the project (in plain English): The user must not sell the source code or any derivatives. The user must not sell the framework or any derivatives. The user is allowed to sell a program which uses the framework. Basically, I just don't want anyone to abuse the open source aspect of the project, take what I've done and turn around and sell it.
