  • Mutually beneficial IP/copyright clauses for contract-based freelance work

    I have a copyright section in the contract I give to my clients stating that I retain copyright on any works produced during my work for them as an independent contractor. This is most definitely not intended to place arbitrary restrictions on my clients, but rather to maintain my ability to decide on how the software I create is licensed and distributed. Almost every project I work on results in at least one part of it being released as open source. Every project I work on makes use of third-party software released in the same fashion, so returning the favour is something I would like to continue doing. Unfortunately, the contract is not so clear when it comes to defining the rights of the client in the use of said software. I mention that the code will be licensed to them, but do not mention specifics about exclusivity, ability to produce derivatives etc. As such, a client has raised concerns about the copyright section of my contract, and has suggested that I reword it such that all copyrights are transferred entirely to the client on final payment for the project. This will almost certainly reduce my ability to distribute the software I have created; I would much prefer to find a more mutually beneficial agreement where both our concerns are appeased. Are there any tried and true approaches to licensing software in this kind of situation? To summarise: I want to maintain the ability to license (parts of) the software under my own terms, independently of my relationship with the client; with some guarantee to the client that no trade-secrets or critical business logic will be shared; giving them the ability to re-use my code in their future projects; but not necessarily letting them sell it (I'm not sure about this, though...what happens if they sell their business and the software along with it?) I realise that everyone's feedback is going to be prefixed with "IANAL", however I appreciate any thoughts you might have on the matter.

  • Is MySQL Replication Appropriate in this case?

    I have a series of databases, each of which is basically standalone. It initially seemed like I needed a replication solution, but the more I researched it, the more it felt like replication was overkill and not useful anyway. I have not done MySQL replication before, so I have been reading up on the online docs, googling, and searching SO for relevant questions, but I can't find a scenario quite like mine. Here is a brief description of my issue: The various databases almost never have a live connection to each other. They need to be able to "sync" by copying files to a thumb drive and then moving them to the proper destination. It is OK for the data to not match exactly, but they should have the same parent-child relationships. That is, if a generated key differs between databases, no big deal. But the visible data must match. Timing is not critical. Updates can be done a week later, or even a month later, as long as they are done eventually. Updates cannot be guaranteed to be in the proper order, or in any order for that matter. They will be in order from each database; just not between databases. Rather than a set of master-slave relationships, it is more like a central database (R/W) and multiple remote databases (also R/W). I won't know how many remote databases I have until they are created. And the central DB won't know that a database exists until data arrives from it. (To me, this implies I cannot use the method of giving each its own unique identity range to guarantee uniqueness in the central database.) It appears to me that the bottom line is that I don't want "replication" so much as I want "awareness". I want the central database to know what happened in the remote databases, but there is no time requirement. I want the remote databases to be aware of the central database, but they don't need to know about each other. WTH is my question? It is this: Does this scenario sound like any of the typical replication scenarios, or does it sound like I have to roll my own? Perhaps #7 above is the only one that matters, and given that requirement, out-of-the-box replication is impossible. EDIT: I realize that this question might be more suited to ServerFault. I also searched there and found no answers to my questions. And based on the replication questions I did find both on SO and SF, it seemed that the decision was 50-50 over where to put my question.   • Counting point size based on chart area during zooming/unzoomin

    Hi folks. I heave a quite simple task. I know (I suppose) it should be easy, but from the reasons I cannot understand, I try to solve it since 2 days and I don't know where I'm making the mistake. So, the problem is as follows: - we have a chart with some points - The chart starts with some known area and points have known size - we would like to "emulate" the zooming effect. So when we zoom to some part of the chart, the size of points is getting proportionally bigger. In other words, the smaller part of the chart we select, the bigger the point should get. So, we have something like that. We know this two parameters: initialArea; // Initial area - area of the whole chart, counted as width*height initialSize; // initial size of the points Now lets assume we are handling some kind of OnZoom event. We selected some part of the chart and would like to count the current size of the points float CountSizeOnZoom() { float currentArea = CountArea(...); // the area is counted for us. float currentSize = initialSize * initialArea / currentArea; return currentSize; } And it works. But the rate of change is too fast. In other words, the points are getting really big too soon. So I would like the currentSize to be invertly proportional to currentArea, but with some scaling coefficient. So I created the second function: float CountSizeOnZoom() { float currentArea = CountArea(...); % the area is counted for us. // Lets assume we want the size of points to change ten times slower, than area of the chart changed. float currentSize = initialSize + 0.1f* initialSize * ((initialArea / currentArea) -1); return currentSize; } Lets do some calculations in mind. if currentArea is smaller than initialArea, initialArea/currentArea > 1 and then we add "something" small and postive to initialSize. Checked, it works. Lets check what happens if we would un-zoom. currentArea will be equal to initialArea, so we would have 0 at the right side (1-1), so new size should be equal to initialSize. Right? Yeah. So lets check it... and it doesn't work. My question is: where is the mistake? Or maybe you have any ideas how to count this scaled size depending on current area in some other way?

    Here's the scenario: Many users access an application (running on tomcat), the user's data is segmented into multiple databases, say each db containing 1000 user's data. Now is it somehow possible to have 100s of tomcat servers running on 'inexpensive' PC class machines with each connecting to a single db, with user's session getting passed to appropriate tomcat and becoming 'Sticky' there. Can have some sort of 'gateway' deciding which user goes where and doing the load-balancing appropriately. Would make a great scalability solution :)

Consider the following scenario: A state machine is used in a workflow engine, and after the state of the application is changed, a series of commands are executed. Depending on the state, different types of commands should be executed. As I see it, one implementation is to create List<IAction> and have each individual action determine whether it should execute. Would a Aspect Oriented process work as well? That is, could you create an aspect that notifies a class when a property changes, and execute the appropriate processes from that class? Would this help centralize the state specific rules?

    Im using a couple of JS functions to set a cookie named 'visible' with the value of either yes or no. Essentially Im using these values to decide if a <div> is visible or hidden. I've only just added the cookie, previously I had been using two images 1. Show 2. Hide as a button to hide and show the <div> like this: HTML: <img class="show" title="Show" alt="Show" src="images/show.png" /> <img class="hide" title="Hide" alt="Hide" src="images/hide.png" /> JQUERY: $("#tool").click(function() { $(".help").slideToggle(); $("#wrapper").animate({ opacity: 1.0 },200).slideToggle(200, function() { $("#tool img").toggle(); }); }); However I have now added the Cookie into the mix: $("#tool").click(function() { if(get_cookie('visible')== null) { set_cookie('visible','no'); } else { delete_cookie('visible'); } $(".help").slideToggle(); $("#wrapper").animate({ opacity: 1.0 },200).slideToggle(200, function() { $("#slider img").toggle(); }); }); So the .toggle() no longer matches the state of the <div> When the cookie value = no the show.png should be visible When the cookie value = yes then the hide.png should be visible Can anyone suggest how i can ammend this?

  • When to use @Singleton in a Jersey resource

    I have a Jersey resource that access the database. Basically it opens a database connection in the initialization of the resource. Performs queries on the resource's methods. I have observed that when I do not use @Singleton, the database is being open at each request. And we know opening a connection is really expensive right? So my question is, should I specify that the resource be singleton or is it really better to keep it at per request especially when the resource is connecting to the database? Flash has a number of tools/libs like this, i'm sure jQuery has seen similar. Ideally something that offers a range of easing effects as well.   • Android Frame based animation memory problem

    Hi all Im trying to create a animation on top of a Camera Surface view. The animation if a box rotating, and to enable transparency i made a bunch of *.png files that i want to just switch out on top of the Camera view. The problem is Android wont allow me to allocate so many images (too much memory required) so the AnimationDrawable is not an option. Will i be able to allocate all the *.png bitmaps if i use OpenGL instead? then i would store all the *.png's as Textures and just make my own animation logic? is am i under the same restrictions there? Any ideas on how to solve this problem ? Ive made a Custom view that loads the image resource on every frame and discards it when next frame is to be displayed.     I have a ~300.000 row table; which includes technical terms; queried using PHP and MySQL + FULLTEXT indexes. But when I searching a wrong typed term; for example "hyperpext"; naturally giving no results. I need to "compansate" little writing errors and getting nearest record from database. How I can accomplish such feaure? I know (actually, learned today) about Levenshtein distance, Soundex and Metaphone algorithms but currently not having a solid idea to implement this to querying against database. Best regards. I think it might be something to do with how my files are nested but it makes no sense. I am opening the SQL connection in the header file.     Hi, I want to develop a program that copies a partition's 'data' only, to another partition. And I want to do it such that the program starts from the first sector of source partition and checks if a sector is used. If it is used copy it to the destination parition. Else don't copy. In other words it's like copying only the contents of a partition to another, sector-by-sector. Question: Is there a way to check if a particular sector on harddisk is used or not? The programming language I am using is C++ and the underlying filesystem in NTFS. Thanks a lot.

    I have an app with multiple users. Each user as a theoretical role (user, client, etc). I've designed a view/controller for each user type. I want to be able to login each type of user do a different root url and lock them to it. Originally I was going to add a column to Users in Devise called role and so I can differentiate the users. The problem I'm having is how to say in routes.rb if current_user.role == "client" root :to = 'controller#index' Once they are logged in to the page I also want to keep them from being able to visit any of my other paths ie: domain.com/calls domain.com/units I've been looking into cancan to run alongside Devise but I'm not sure if this is the answer.

    So I have my rails application and I have blog posts in my application. For starters I am on rails 2.3.5 and Ruby 1.8.7 For the show page, I am required to give a prev/next link to the prev/next blog post. The catch is that I need to find the next blog where the language column in the database is equal to 'eng'. I had started writing this out in my model and it works but of course this will just find the prev/next record in the database no matter what the language is specified in the column and it will break when the record is not found. def next(lang='eng') BlogEntry.find(self.id - 1) end def prev(lang='eng') BlogEntry.find(self.id + 1) end
