  • jQuery and jQuery UI (Dual Licensing)

    - by John Hartsock
OK I have read many posts regarding Dual Licensing using MIT and GPL licenses. But Im curious still, as the wording seems to be inclusive. Many of the Dual Licenses state that the software is licensed using "MIT AND GPL". The "AND" is what confuses me. It seems to me that the word "AND" in the terms, means you will be licensing the product using both licenses. Most of the posts, here on stackoverflow, say you can license the software using one "OR" the other. JQuery specifically states "OR", whereas JQuery UI specifically States "AND". Another Instance of the "AND" would be JQGrid. Im not a lawyer but, it seems to me that a legal interpretation of this would state that use of the software would mean that your using the software under both licenses. Has anyone who has contacted a lawyer gotten clarification or a definitive answer as to what is true? Can you use Dual licensed software products that state "AND" in the terms of agreement under either license?

  • virtualbox ose windows binaries

    - by Eye of Hell
Hello Sun's virtualbox windows binaries are under 'non-commercial' license so can't be used in any company. But source code is GPL. Is it any resource on the network that has a virtualbox compiled binaries for windows? Added a bounty to see if I can get a little more feedback.

  • Are Ms-PL and Apache License Version 2.0 Compatible?

    - by Carlos Díez
I need to use two libraries in a commercial product that i'm developing at work. One library is under the Ms-PL license and the other is under Apache License Version 2.0. I know that Ms-PL is not compatible with GPL according to the FSF, and that the Apache License Version 2.0 is only compatible with GPLv3 (and not with GPLv1 or GPLv2). But i don't know if both licenses are compatible. Any help would be appreciated, even if it is that it is impossible :)

  • What power do I have over my license?

    - by DavidG
Say for example, I've written some code under GPL 3. My company wants to use that code for a commercial product. Am I allowed to then say to them that they can use it under LGPL/MIT or any other license? If so, would I then have to change the included header at the top of each file? If so, what is stopping someone else from changing the license on my code?

  • Gplv3 and consulting

    - by Mjgp2
If you are doing a one off piece of work as a consultant, for which the client receives only binaries, can you use gpl3 software ? You are working on behalf of the client and not distributing it. From a standard gpl FAQ: Q: I am an OXID partner/reseller/consultant and I occasionally do one-time OXID eShop Community Edition customization work for clients which are derived from OXID modules. These customizations are used only for the client. Do I need to make these changes publicly available? A: No, unless your client redistributes the code in which case the client must make it available to its licensees. Is this implying it is ok?

  • Can I redistribute Phing with non-free software?

    - by Matt1776
I am having trouble understanding the terms of the LGPL in light of a program that is not written in C or C++. They speak of libraries being linked and 'derivitive' works. If I were to package a php program and sell it, but within the program the deployment mechanism used the phing package (full up with the entire contents as is and un modified) - would I be violating the terms of the LGPL? For example, If this was a C program that was compiled by linking the phing 'library' then the answer would be easier, it is a derivitive work and therefore unless released under the GPL will not be considered free and also a violation. But this situation is different. I am not linking and not producing a derivitive, i am simply using phing as a deployment tool to move files around and set up the enviornment. Can someone shed some light? Thank you!

  • C++: what regex library should I use?

    - by Stéphane
I'm working on a commercial (not open source) C++ project that runs on a linux-based system. I need to do some regex within the C++ code. (I know: I now have 2 problems.) QUESTION: What libraries do people who regularly do regex from C/C++ recommend I look into? A quick search has brought the following to my attention: 1) Boost.Regex (I need to go read the Boost Software License, but this question is not about software licenses) 2) C (not C++) POSIX regex (#include <regex.h>, regcomp, regexec, etc.) 3) http://freshmeat.net/projects/cpp_regex/ (I know nothing about this one; seems to be GPL, therefore not usable on this project) Thanks.

  • License similar to the MIT license but without the ability to sell?

    - by Ben
I'm trying to decide how I want to license my Wordpress themes to the public. I know that the GPL is recommended to Wordpress theme creators, however I feel it might not be liberal enough for me because I want businesses to be able to use them if they want to. I really like the MIT license, the only thing that gets me is the freedom to sell part. I don't want someone taking my themes and selling them on some theme farm site, they should be free for everyone, however I don't want to require them to republish any changes under the MIT as well, I think that that freedom should remain intact. Is there a license that sort of fits into the terms I specified here? I'm not a lawyer so I have trouble reading through the complicated language of licenses. If there is not a similar license to the MIT but with the terms I have specified, should I just license under a modified MIT? If so, can anyone help me write it? Thanks very much!

  • Can LGPL licenses be used in our proprietary systems?

    - by jon
We want to use either the FCK/CKeditor or the TinyMCE editor in our CRM application. We charge the customer use of the CRM system which is bespoke to use and them. I noticed both the editors have GPL and LGPL licenses. However CKEditor has a Closed License too in addition to the LGPL. My questions are: 1) Although we don't sell our code or binaries, we provide software as a hosted service, can we use LGPL licenses? 2) Why does CKEditor provide LGPL and Closed licenses if the LGPL should make it easy for any proprietary software to use it? Is it only for systems which are sold as a binary where the product is for example physically installed as an .exe?

  • Is my concept in open source license correct?

    - by tester
I would like to justify whether my concept in the open source license is correct, as you know that, misunderstanding the terms may lead to a serious law sue. Thank you. The main difference among the open source license is whether the license is copyleft. Copyleft license means allow the others to reproduce, modify and distribute the products but the released product is bound by the same licensing restriction. That means they have to use the same license for the modified version. Also, the copyleft license require all the released modified version to be free software. On the other hand, if any others create derived work incorporating non-copyleft licensed code, they can choose any license for the code. The serveral kinds of license and comparsion GPL is a restrictive license. Software requires to released as GPL license if that integrate or is modified from the other GPL license software . The library used in developing GPL license software are also restricted to GPL and LGPL , proprietary software are not allowed to employ (or complied with) in any part of the GPL application. LGPL is similar to GPL , but was more permissive with regarding allow the using of other non-GPL software. BSD is relatively simple license, it allow developer to do anything on the original source code . The license holder do not hold any legal responsibilities for their released product. Apache license is evolved from the BSD license. The legal terms are improved and are written by legal professionals in a more modern way. It covers comprehensive intellectual property ownership and liability issues. Also, are there any popular license beside these? Thank you

  • Conceal packet loss in PCM stream

    - by ZeroDefect
I am looking to use 'Packet Loss Concealment' to conceal lost PCM frames in an audio stream. Unfortunately, I cannot find a library that is accessible without all the licensing restrictions and code bloat (...up for some suggestions though). I have located some GPL code written by Steve Underwood for the Asterisk project which implements PLC. There are several limitations; although, as Steve suggests in his code, his algorithm can be applied to different streams with a bit of work. Currently, the code works with 8kHz 16-bit signed mono streams. Variations of the code can be found through a simple search of Google Code Search. My hope is that I can adapt the code to work with other streams. Initially, the goal is to adjust the algorithm for 8+ kHz, 16-bit signed, multichannel audio (all in a C++ environment). Eventually, I'm looking to make the code available under the GPL license in hopes that it could be of benefit to others... Attached is the code below with my efforts. The code includes a main function that will "drop" a number of frames with a given probability. Unfortunately, the code does not quite work as expected. I'm receiving EXC_BAD_ACCESS when running in gdb, but I don't get a trace from gdb when using 'bt' command. Clearly, I'm trampimg on memory some where but not sure exactly where. When I comment out the *amdf_pitch* function, the code runs without crashing... int main (int argc, char *argv[]) { std::ifstream fin("C:\\cc32kHz.pcm"); if(!fin.is_open()) { std::cout << "Failed to open input file" << std::endl; return 1; } std::ofstream fout_repaired("C:\\cc32kHz_repaired.pcm"); if(!fout_repaired.is_open()) { std::cout << "Failed to open output repaired file" << std::endl; return 1; } std::ofstream fout_lossy("C:\\cc32kHz_lossy.pcm"); if(!fout_lossy.is_open()) { std::cout << "Failed to open output repaired file" << std::endl; return 1; } audio::PcmConcealer Concealer; Concealer.Init(1, 16, 32000); //Generate random numbers; srand( time(NULL) ); int value = 0; int probability = 5; while(!fin.eof()) { char arr[2]; fin.read(arr, 2); //Generate's random number; value = rand() % 100 + 1; if(value <= probability) { char blank[2] = {0x00, 0x00}; fout_lossy.write(blank, 2); //Fill in data; Concealer.Fill((int16_t *)blank, 1); fout_repaired.write(blank, 2); } else { //Write data to file; fout_repaired.write(arr, 2); fout_lossy.write(arr, 2); Concealer.Receive((int16_t *)arr, 1); } } fin.close(); fout_repaired.close(); fout_lossy.close(); return 0; } PcmConcealer.hpp /* * Code adapted from Steve Underwood of the Asterisk Project. This code inherits * the same licensing restrictions as the Asterisk Project. */ #ifndef __PCMCONCEALER_HPP__ #define __PCMCONCEALER_HPP__ /** 1. What does it do? The packet loss concealment module provides a suitable synthetic fill-in signal, to minimise the audible effect of lost packets in VoIP applications. It is not tied to any particular codec, and could be used with almost any codec which does not specify its own procedure for packet loss concealment. Where a codec specific concealment procedure exists, the algorithm is usually built around knowledge of the characteristics of the particular codec. It will, therefore, generally give better results for that particular codec than this generic concealer will. 2. How does it work? While good packets are being received, the plc_rx() routine keeps a record of the trailing section of the known speech signal. If a packet is missed, plc_fillin() is called to produce a synthetic replacement for the real speech signal. The average mean difference function (AMDF) is applied to the last known good signal, to determine its effective pitch. Based on this, the last pitch period of signal is saved. Essentially, this cycle of speech will be repeated over and over until the real speech resumes. However, several refinements are needed to obtain smooth pleasant sounding results. - The two ends of the stored cycle of speech will not always fit together smoothly. This can cause roughness, or even clicks, at the joins between cycles. To soften this, the 1/4 pitch period of real speech preceeding the cycle to be repeated is blended with the last 1/4 pitch period of the cycle to be repeated, using an overlap-add (OLA) technique (i.e. in total, the last 5/4 pitch periods of real speech are used). - The start of the synthetic speech will not always fit together smoothly with the tail of real speech passed on before the erasure was identified. Ideally, we would like to modify the last 1/4 pitch period of the real speech, to blend it into the synthetic speech. However, it is too late for that. We could have delayed the real speech a little, but that would require more buffer manipulation, and hurt the efficiency of the no-lost-packets case (which we hope is the dominant case). Instead we use a degenerate form of OLA to modify the start of the synthetic data. The last 1/4 pitch period of real speech is time reversed, and OLA is used to blend it with the first 1/4 pitch period of synthetic speech. The result seems quite acceptable. - As we progress into the erasure, the chances of the synthetic signal being anything like correct steadily fall. Therefore, the volume of the synthesized signal is made to decay linearly, such that after 50ms of missing audio it is reduced to silence. - When real speech resumes, an extra 1/4 pitch period of sythetic speech is blended with the start of the real speech. If the erasure is small, this smoothes the transition. If the erasure is long, and the synthetic signal has faded to zero, the blending softens the start up of the real signal, avoiding a kind of "click" or "pop" effect that might occur with a sudden onset. 3. How do I use it? Before audio is processed, call plc_init() to create an instance of the packet loss concealer. For each received audio packet that is acceptable (i.e. not including those being dropped for being too late) call plc_rx() to record the content of the packet. Note this may modify the packet a little after a period of packet loss, to blend real synthetic data smoothly. When a real packet is not available in time, call plc_fillin() to create a sythetic substitute. That's it! */ /*! • A New Closed Source Viral License

The copyleft provisions of the GPL (GNU General Public License) require that any changes or additions to a GPL licensed work must itself be licensed under terms that adhere to the GPL. Critics of these copyleft provisions have derogatively labeled the GPL as a viral license. Such criticism points out that any code that seeks to incorporate GPL licensed code must itself adhere to the terms of the GPL, thus potentially infecting other code with its restrictions. This has caused many developers of...Did you know that DotNetSlackers also publishes .net articles written by top known .net Authors? • Incorporating MIT/X11 licensed code into project

    - by Yktula
I'm rewriting a small MIT-licensed program in C, and I intend to copy a segment from it (though not verbatim) that prints usage information and such things. The programs are going to behave, for the most part, the same, but the implementations are going to be much different. What is the best way to incorporate this code into my program, whether it's licensed under Apache 2, GPLv2/3, or under the MIT license? My guess is that for the first two listed I'd just add the original authors name to the NOTICE file along with relevant information and paste the license header as a comment above the derived code, and for the latter I'd just add the original author's copyright statement above my own.

Can i put the same samples in my website. There is a GNU license associated with it.Can somebody interpret it for me to answer these questions 1 . Can i use it in my website without getting a permission from anyone ? 2 . Do i need maintain the same files always ? Can i make some customization and use it ? Customization is only the CSS changes its going to be. 3 . Do i need to put all the files as it is of the package which downloaded.because my download has samples which supports all languages. Do i need to put all those folders too From GNU license " if you distribute copies of such a program, whether gratis or for a fee, you must pass on to the recipients the same freedoms that you received. You must make sure that they, too, receive or can get the source code. And you must show them these terms so they know their rights."

  • Can I use/include gsdll32.dll redmonnt.dll (no modificaitons) in a commercial application for my cli

    - by scriptmaster
Hi - I am not a license expert, however after a lot of research, I am still struggling to answer the following questions and would like to know if my assumptions are right! 1) Is it legal to include gsdll32.dll and redmonnt.dll in a commercial product? A: ? 2) Should I release any source code of the commercial app where I am using this library? A: ? 3) Is there a commercial license (a small fee that my client can pay to use these libraries) to GhostScript? A: ? 4) Whats the meaning of "although it may be distributed ("aggregated") with commercial products." in this para: http://pages.cs.wisc.edu/~ghost/doc/AFPL/8.00/New-user.htm#Commercial_use A: ? 5) What are the alternate solutions? A: ?

I was reading a bit on GPL, but that seems to be more suited for system code and libraries, AFAIK, as it doesn't permit the use of code for proprietorial software - which, in turn, implies that the code can be used in the first place. I can see that, obviously, game engines can be considered libraries, and therefor be used, but what about game code? Is there an alternative to GPL?
